I wasn't replying to you at all but to anyone in general who goes on a hacking forum claiming to walk around with big golden halo floating above their head.

You are aware there are people who hack their console or work on hacks for consoles without the aim of piracy, right? You're a fool if you think otherwise.

    1) Homebrew, some people just like using/developing homebrew
    2) "Legitimate" backups of games (Still a legal grey area because laws are stupid) so you don't have to carry your carts around
    3) The fun of breaking open a system that you were never meant to have access to

I got my first ds flashcart to run nds_tgm. A homebrew. I had investigated Datel games and music, and determined that it's compatibility level was too low for decent homebrew.

Do people pirate with hacks? Yes.

    But not everyone does.

Oddly enough a useful homebrew only (and thus legal) DS cart would have been trivial to develop. add dldi autopatching (any decent ds cart has it). remove sram support. DONE. Instant antipiracy flashcart. HOmebrew works. commercial games (all of which require sram to run) do not.

    ¯\_(ツ)_/¯
Never once did I deny that it could be used for piracy. I only covered the legal standing of the homebrew and the counter argument to accessing Nintendo’s servers.
Also I didn’t deny being a pirate, I only stated my main reason for using freeShop. I mainly use it to avoid the eShop, that’s not a denial of any secondarily actions.

I don't know what everyone else thinks, but I think that it kind of depends how you use it.

For example I think if you already own the game but you own a game card of it and you want a downloaded version as well just because it is more convenient because it is easy to carry more games with you because it doesn't take up much room and is just in your 3ds but if your downloading games you don't own for free then I could say that is probs illegal :D :D

And while you're at it you've got a hundred other 3ds games for free at the tip of your fingers... but you're not going to touch them? So many bs comments it's making me laugh. But hey! Keep at it!

Yeah :rofl2: , lets talk realistically you can any game for free, their are 100s of games to download surely your not just gonna get games that you already own just for the sake of having two versions of the game I'm sure 10/10 of us would atleast download 1 game for free, come on :D :D

No one is denying that it can be used for piracy. You are bringing up the same argument that has already been brought up be people who only read the title and nothing more.

Isn't that technically the same as lending your DS or game to a friend to play a game though? ;) And what happens if you give away the cartridge, but keep the personal backup? The first part was a joke, but now I am curious about that second part.

If you sell the cart you must delete the backup

That said, I think Nintendo has better things to do than going after kids that swap their game cards in the school playgrounds.

    I was following
, without written legal consent by nintendo lend is prohibited so once the game change owner the backup must be removed.
You cannot play the backup and if caught justify it as "i lend it to my buddy, i'm still the owner." No, you are not.

I know its a very hypothetical discussion right now but still my 2 cents.

Legally, if you lend your cartridge to a buddy, you transfer the ownership. Therefor you have no rights to hold a backup of the cartridge mean you have to delete it.
You can always do a new backup if you get your cartridge back. If its broken by your buddy you're out of luck. If you are concerned about your property, dont give it away.

Do you have an encTitleKeys.bin file in SD:/3ds/data/freeshop?
If not, do you have it set to download one from a URL?
